Terms of Service

PICO is a parcel tracking and pickup coordination service that includes a mobile application, an optional Gmail-based parcel sync feature, household and group sharing functionality, and a business portal for pickup-point stores. These Terms apply to all users — consumers, household members, and business users — unless a separate business agreement supersedes them.

These Terms are entered into between you and PICO ("we", "us", "our"). When we refer to "PICO", "the service", or "the platform", we mean all products operated by us at pico-ai-app.com and in the PICO mobile application.

• You must be at least 16 years old to use PICO.
• If you are between 16 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• You must have the legal capacity to enter into a binding agreement in your jurisdiction.
• You may not use PICO if you have been previously banned from the service.

You sign in to PICO using Google OAuth. You are responsible for maintaining the security of your Google account. Any action taken from your account is considered to have been authorized by you.

• You must provide accurate account information.
• You may not share your account credentials or allow others to use your account.
• You must notify us immediately at support@pico-ai-app.com if you suspect unauthorized access.
• We are not liable for losses arising from unauthorized use of your account where you failed to take reasonable precautions.

PICO offers an optional Gmail connection feature that reads your inbox to auto-detect parcel emails. Gmail access is requested only after you are signed in and explicitly choose to enable it.

• By connecting Gmail, you grant PICO read-only access to your Gmail data for parcel detection purposes as described in the Privacy Policy.
• You can disconnect Gmail at any time from your profile settings, which immediately stops all mailbox access.
• You can also revoke access via your Google Account permissions page at any time.
• PICO's use of Gmail data is governed by the Google API Services User Data Policy, including Limited Use requirements.

You agree not to:

• Use PICO for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
• Attempt to gain unauthorized access to any part of the service, other user accounts, or backend systems.
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of PICO.
• Use automated scripts, bots, scrapers, or crawlers to access the service without our prior written consent.
• Upload, transmit, or share content that is unlawful, harmful, defamatory, abusive, or infringes any third-party rights.
• Misrepresent parcel ownership, fabricate pickup codes, or impersonate other users or businesses.
• Interfere with or disrupt the integrity or performance of the service or its infrastructure.
• Use the service to send spam, unsolicited communications, or misleading content to other users.
• Resell, sublicense, or offer the service as a white-label product without a separate written agreement.

We reserve the right to suspend or terminate accounts that violate these usage rules, with or without notice.

PICO and all associated intellectual property — including the software, design, trademarks, logos, text, graphics, and the "PICO" name — are owned by or licensed to us and are protected by applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use PICO solely for its intended personal or business parcel coordination purpose.

You retain ownership of any parcel data and content you create. By using the service, you grant us a limited license to process, store, and display that content solely to provide and operate the service. We do not claim ownership of your data.

If you use PICO's business portal to register a pickup-point store or manage business operations, you additionally agree to:

• Provide accurate and up-to-date business information including name, address, and operating hours.
• Use customer interaction features only for legitimate pickup coordination purposes.
• Comply with all applicable laws relating to your business operations and customer data handling.
• Not misuse consumer-facing features to spam, deceive, or defraud end users.

PICO integrates with third-party services including Google (sign-in and Gmail), Apple (push notifications), and cloud infrastructure providers. These services have their own terms and privacy policies that apply independently of PICO. We are not responsible for the availability, accuracy, or conduct of third-party services.

Links or integrations with external services do not constitute our endorsement of those services.

We strive to provide a reliable service but do not guarantee uninterrupted or error-free availability. We may at any time:

• Modify, suspend, or discontinue any feature or the entire service, temporarily or permanently.
• Update the service to add, remove, or change functionality.
• Perform maintenance that temporarily affects availability.

We will endeavor to give reasonable notice of significant changes where possible. We are not liable for any service interruption, data loss, or inconvenience resulting from planned or unplanned downtime.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT.

We do not warrant that:

• The service will be uninterrupted, secure, or error-free.
• Parcel data detected from Gmail will be complete, accurate, or up to date.
• Pickup information, store details, or navigation guidance will be accurate at all times.
• Any errors or defects in the service will be corrected.

Parcel tracking information is based on data extracted from emails and is provided for informational purposes only. Always verify critical pickup information with the relevant carrier or store directly.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PICO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, MISSED PICKUPS, ADDITIONAL COSTS, OR SERVICE INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

You agree to defend, indemnify, and hold harmless PICO and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your violation of these Terms.
• Your use of the service in a manner not permitted by these Terms.
• Your violation of any applicable law or the rights of any third party.
• Content or data you submit to the service.

By you: You may stop using PICO at any time. To delete your account and associated data, contact us at support@pico-ai-app.com.

By us: We may suspend or terminate your access to PICO at any time, with or without notice, for reasons including but not limited to: violation of these Terms, suspected fraud, abuse, or conduct harmful to the service or other users.

Upon termination: your right to use the service ends immediately; we will delete your account data in accordance with our Privacy Policy; sections that by their nature should survive termination (including Sections 10, 11, 12, 14, and 15) will remain in effect.

These Terms are governed by and construed in accordance with the laws of Israel, without regard to conflict-of-law principles. You and PICO agree to submit to the exclusive jurisdiction of the courts located in Tel Aviv-Yafo, Israel, for the resolution of any disputes arising out of or relating to these Terms or the service.

If you are a consumer resident in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify active users through the app or by email with reasonable advance notice. Your continued use of PICO after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the service.

• Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PICO regarding the service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to a successor entity in connection with a merger or acquisition.
• Language: These Terms are provided in English. In the event of a conflict between translated versions and the English version, the English version shall prevail.
